TERMS AND CONDITIONS

Welcome to Moto Reveries Ltd (“Moto Reveries,” “We,” “Our,” or “Us”), a company incorporated under the laws of England and Wales. These Terms and Conditions (the “Terms”) govern your use of our website, mobile applications, and related services accessible via https://motoreveries.com (collectively, the “Platform”).

Moto Reveries operates as a digital marketplace that connects motorcycle enthusiasts (“Riders,” “You,” or “Your”) with independent tour operators (“Tour Operators”) offering motorcycle tours, training sessions, and travel experiences across the globe.

By accessing or using the Platform or any services offered by Moto Reveries, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any other policies, guidelines, or rules published on the Platform from time to time. If you do not agree with any part of these Terms, you must refrain from using the Platform or any related services.

DEFINITIONS

“Platform” refers to the website operated by Moto Reveries at https://motoreveries.com, including all associated mobile applications, subdomains, and related services that facilitate connections between Riders and Tour Operators for motorcycle tours, trips, and training sessions. “Services” means all functionalities and features provided by Moto Reveries through the Platform, including but not limited to user account creation, listing and discovery of tours, booking facilitation, payment processing via Stripe Connect, messaging between users, and hosting of content such as reviews and multimedia. “Users” refers to all individuals or entities who access or use the Platform or its Services, including both Riders and Tour Operators as defined below. “Rider” refers to any individual who accesses or uses the Platform to search for, book, or participate in motorcycle-related tours, trips, or training sessions offered by Tour Operators. “Tour Operator” means any individual or legal entity who lists, markets, or provides motorcycle tours, trips, or training sessions through the Platform for booking by Riders. “Booking” means a confirmed reservation for a specific motorcycle tour, trip, or training session made by a Rider through the Platform and accepted by a Tour Operator, subject to the applicable payment and cancellation terms. “User-Generated Content” includes all photographs, videos, descriptions, reviews, feedback, comments, or other materials uploaded, posted, or submitted by Users to the Platform. “Platform Fees” refers to the fees charged by Moto Reveries to both Riders and Tour Operators as a percentage of the payment for each Booking, in consideration for access to and use of the Platform, including booking facilitation and payment processing services. These fees are deducted at source or invoiced separately, as applicable. “Service Fees” refers to the fees charged by Moto Reveries to Tour Operators in consideration for access to and use of the Platform, including booking facilitation and payment processing services. These may be deducted at source or invoiced separately, as applicable. “Stripe Connect” is the third-party payment processing system integrated into the Platform, which enables secure collection, holding, and distribution of payments between Riders and Tour Operators. “Escrow” refers to the mechanism by which payments made by Riders are held securely by the payment processor until specified conditions, such as the successful commencement or completion of a tour, are fulfilled, after which funds are released to the Tour Operator.

ELIGIBILITY

To use the Platform or Services, you must: Be at least Eighteen (18) years of age and have the legal capacity to enter into a binding contract. Not be prohibited from using the Services under applicable laws, including sanctions or regulatory restrictions. Provide accurate and complete information during registration or booking. Users may be required to provide proof of age (e.g., government-issued ID) during registration or booking to confirm eligibility under Section 2.1.1. Moto Reveries reserves the right to refuse or cancel Bookings or access if eligibility criteria are not met.

SERVICES

Description of Services: Moto Reveries operates as a neutral digital marketplace that connects individual Riders with independent Tour Operators offering motorcycle tours, trips, and training programs across various global destinations. The Platform provides the following core Services: Search and Discovery: Users may search for tours, trips, or training sessions based on multiple filters, including destination, pricing, availability, duration, and type of experience. Booking Facilitation: Moto Reveries enables Riders to make secure, real-time reservations with selected Tour Operators through a streamlined booking interface integrated into the Platform. Payment Processing: All payments are securely processed via Stripe Connect, with funds typically held in Escrow until the tour or training session commences, in accordance with the applicable payment schedule. Community Engagement: The Platform fosters interaction among Riders, Tour Operators, and motorcycle enthusiasts by offering features such as public profiles, messaging, reviews, and other community tools. All communications between Riders and Tour Operators must occur exclusively through the Platform’s messaging system to ensure transparency and compliance with these Terms. Tour Operator Listings: Tour Operators are provided with self-service tools to create, manage, and promote listings for their motorcycle tours, trips, or training sessions, including uploading itineraries, pricing, and availability. Service Availability: All services listed on the Platform are subject to availability. Moto Reveries does not guarantee continuous availability of any particular tour or training session, as offerings are determined by the Tour Operators’ own schedules, capacity, and external factors (e.g., weather, safety, local regulations). Moto Reveries may temporarily suspend access to the Platform for scheduled maintenance or unforeseen technical issues. We will endeavor to provide advance notice of planned maintenance where possible. Third-Party Suppliers: Moto Reveries is not a tour provider and does not own, operate, or manage any tours or training sessions listed on the Platform. The provision, quality, safety, and fulfillment of all services are the sole responsibility of the respective Tour Operators and their third-party suppliers. Moto Reveries shall not be held liable for any deficiencies in service delivery or acts or omissions of Tour Operators.

PLATFORM ROLE AND TOUR OPERATOR RESPONSIBILITY

Intermediary Platform Only: Moto Reveries operates solely as a neutral, intermediary platform designed to facilitate connections between independent third-party Tour Operators and Riders seeking motorcycle tours, training sessions, and related experiences. Moto Reveries does not organize, own, manage, operate, or control any tours, training programs, accommodations, transportation, or related services offered through the Platform. No Endorsement or Guarantee: The availability of a Tour Operator or any tour listing on the Platform does not constitute an endorsement, guarantee, or warranty by Moto Reveries as to the reliability, legality, quality, safety, or suitability of the Tour Operator or the services offered. Riders are solely responsible for evaluating the offerings of Tour Operators and making informed decisions before engaging their services. Sole Responsibility of Tour Operators: Tour Operators are solely and fully responsible for: the planning, management, and delivery of the tours and services they offer; compliance with all applicable laws, safety standards, permits, and licensing requirements in the jurisdictions where they operate; providing accurate and up-to-date information regarding tour itineraries, pricing, inclusions, exclusions, and terms; and handling all matters relating to the execution of the tour, including participant safety, logistics, and customer service. No Control Over Tour Execution: Moto Reveries does not supervise, control, direct, or monitor the conduct or performance of any Tour Operator or the services they render. All interactions, bookings, and participation in tours are undertaken at the Rider’s sole risk, and Moto Reveries bears no responsibility for the acts, omissions, delays, negligence, or misconduct of any Tour Operator. Limitation of Liability: Moto Reveries shall not be held liable for any loss, injury, damage, inconvenience, delay, or claim arising from or related to the actions or omissions of any Tour Operator, including cancellation, misrepresentation, breach of contract, or failure to provide services. Any such claims must be resolved directly between the Rider and the respective Tour Operator. Listing Oversight: Moto Reveries reserves the right to review, edit, suspend, or remove any listing that does not meet its quality standards, contains misleading information, or receives consistent negative feedback from Riders. Tour Operator Suspension or Removal: Moto Reveries reserves the right to suspend or remove Tour Operators with repeated cancellations, complaints, safety violations, or substandard experiences, based on internal reviews or Rider feedback.

BOOKING CONDITIONS

Booking Process: Riders may book motorcycle tours, trips, or training sessions directly through the Platform by selecting an available listing provided by a Tour Operator and following the booking procedure. A Booking shall be deemed confirmed only upon fulfillment of all the following conditions: (a)Receipt of the required payment amount (whether full or deposit) through the Platform; (b) Explicit acceptance by the Rider of the Tour Operator’s terms and conditions, including any applicable waivers or liability agreements; and (c) Issuance of a booking accepted email from Moto Reveries to the Rider, acknowledging the successful reservation. Where applicable, Tour Operators are required to provide Riders with a signed contract, waiver, or formal terms and conditions governing the Booking. It is the responsibility of the Tour Operator to ensure that such documents are accurate, legally valid, and properly shared with the Rider prior to the start of the tour or training session. Alterations by Rider: Any request to modify Booking details, including but not limited to changes in dates, tour type, participant information, or other material aspects, must be submitted in writing via email to admin@motoreveries.com. Verbal modification requests shall not be considered valid. All modification requests are subject to the sole discretion and approval of the respective Tour Operator. Moto Reveries shall facilitate communication but shall not be liable for any denial or delay in approval of modification requests. Approved modifications may be subject to additional charges, including but not limited to price adjustments, administrative fees, or increased service costs, which shall be communicated to the Rider prior to confirmation of the revised Booking. Alterations by Tour Operator: Tour Operators may make minor changes to the itinerary, schedule, accommodations, or other non-essential aspects of the tour or training session due to availability, weather conditions, safety concerns, or other operational factors. Such changes shall not entitle the Rider to a refund or compensation. In the event of significant changes, such as date alterations, cancellations of key components, or material deviations from the advertised tour, affected Riders will be notified as soon as practicable. Where possible, Riders will be offered: (a) a suitable alternative tour or rescheduled date; or (b) a full or partial refund, in accordance with the applicable Tour Operator’s cancellation and refund policy. Moto Reveries is not the provider of the tour or training session and shall not be liable for any modifications made by the Tour Operator. All remedies for changes rest with the Tour Operator under their respective terms. Booking Models: On-Platform Payments: For Bookings processed through the Platform, payments are handled via Stripe Connect and held in Escrow until the tour or training session is completed, as per the Tour Operator’s terms. Off-Platform Payments: Where payment processing is not available through the Platform (e.g., due to regional restrictions), Moto Reveries facilitates communication between Riders and Tour Operators to arrange payments directly, exclusively through the Platform’s messaging system. Moto Reveries is not responsible for any issues arising from off-platform payments, including non-delivery or disputes.

DEPOSIT AND PAYMENT TERMS

To confirm a Booking, a deposit may be required as specified by the respective Tour Operator. The amount and due date of the deposit will be clearly indicated at the time of booking. Unless otherwise stated by the Tour Operator, the remaining balance of the booking fee must be paid in full no later than twelve (12) weeks prior to the scheduled start date of the tour or activity. The Payment terms for a Booking shall completely be at the discretion of the Tour Operator. For Bookings made within twelve (12) weeks of the tour start date, full payment may be required at the time of booking to secure participation. All transactions on the Platform are currently processed in Great British Pounds (GBP). Moto Reveries reserves the right to introduce multicurrency support in the future, with notice to Users via the Platform or email. All payments are securely processed through Stripe Connect in the designated currency of the Platform. Users agree to comply with all applicable payment terms and authorize the Platform to facilitate such payments on behalf of the Tour Operator. Unless otherwise agreed in writing: Tour Operators are responsible for all currency conversion charges, and applicable taxes (including but not limited to VAT or sales tax). Moto Reveries does not withhold or remit any such taxes on behalf of the Tour Operator unless legally required to do so. Failure to complete payment by the due date, including deposit or final balance, may result in automatic cancellation of the Booking without refund. Users are responsible for ensuring timely payment in accordance with the specified schedule. In certain cases, such as when required by applicable laws or regulations (including but not limited to insolvency insurance requirements in certain jurisdictions), Moto Reveries may release funds held in Escrow to the Tour Operator prior to the commencement of the tour or training session, provided the Rider has been notified and acknowledges the release. Such early release shall be at the discretion of Moto Reveries and in accordance with the Tour Operator’s terms and applicable legal requirements.

PRICING

All prices for tours, trips, experiences, or training sessions listed on the Platform are determined solely by the respective Tour Operators. Moto Reveries does not control or influence the pricing decisions made by Tour Operators. Unless otherwise stated, the listed price includes only those services expressly mentioned in the tour or activity description. These may include, but are not limited to, guided services, planned routes, specified equipment, or entry fees. The listed price does not include: Travel or health insurance; Personal expenses (e.g., meals, souvenirs, tips); Any optional or additional services not expressly included in the tour description. Prices are subject to change based on seasonal variations, availability, operational changes, or unforeseen circumstances. While Moto Reveries and the Tour Operators strive to provide timely notice of any price changes, such notice may not always be possible in exceptional situations. Unless otherwise specified, all prices are quoted in the currency indicated on the Platform and may be inclusive or exclusive of applicable taxes, duties, or levies, depending on the jurisdiction and nature of the services. Moto Reveries charges Platform Fees to both Riders and Tour Operators as a percentage of each Booking payment, as specified at the time of booking. Moto Reveries reserves the right to modify Platform Fees or commission rates with at least thirty (30) days’ notice via email or the Platform. Such changes will not affect confirmed Bookings made prior to the effective date of the change.

CANCELLATIONS AND REFUNDS

Cancellation by Rider: Cancellations must be submitted in writing to admin@motoreveries.com and are subject to the Tour Operator’s cancellation policy. Typical cancellation charges (unless otherwise specified): Over 12 weeks before start: Loss of deposit. 12 to 8 weeks before start: 50% of total cost. 8 to 4 weeks before start: 75% of total cost. Less than 4 weeks before start: 100% of total cost. Deposits are non-refundable unless stated otherwise by the Tour Operator. Refund Process: Refunds, if applicable, are processed within 30 days via Stripe Connect, after deducting cancellation charges. Riders may need to provide payment confirmation to facilitate refunds. Moto Reveries is not liable for losses due to currency fluctuations. Cancellation by Tour Operator or Moto Reveries: If a Tour Operator cancels, Moto Reveries will facilitate a refund or alternative arrangements, subject to the Tour Operator’s policy. In rare cases, Moto Reveries may cancel due to platform issues, offering a full refund of platform-processed payments. No-Show Policy: Failure to appear for a tour without prior notice results in forfeiture of the full payment.

USER RESPONSIBILITIES

Rider Responsibilities: Riders agree to the following obligations when using the Platform and participating in tours or training sessions: Ensure they meet all eligibility criteria and requirements specified by the Tour Operator, including possession of a valid motorcycle license, sufficient riding experience, and appropriate safety gear or equipment; Carefully review and agree to the Tour Operator’s specific terms and conditions prior to making a Booking; Provide accurate, current, and complete personal and payment information when using the Platform; Abide by all local laws, road safety regulations, and any tour-specific rules or instructions provided by the Tour Operator or designated guide during the experience. Riders must also disclose any medical conditions, physical limitations, or other factors that may impact their ability to safely participate in a tour or training session. Failure to disclose such information may result in cancellation without refund or exclusion from the activity at the Tour Operator’s discretion Tour Operator Responsibilities: Tour Operators agree to fulfill the following obligations: Provide truthful, complete, and up-to-date information in all tour listings, including pricing, itineraries, participant requirements, and service inclusions/exclusions; Clearly communicate their terms and conditions to Riders prior to Booking confirmation; Comply with all applicable local, regional, and national laws governing tour operations, including insurance, licensing, and safety standards; Must maintain valid public liability insurance and, where applicable, professional indemnity insurance, with minimum coverage as required by local laws or industry standards. Moto Reveries reserves the right to request proof of insurance at any given time. Successfully complete and maintain ongoing compliance with Moto Reveries’ Know Your Customer (KYC) verification process, which includes submission of valid government-issued identification, proof of lawful business operations, and, where applicable, licenses or permits required to operate tours or training sessions. Moto Reveries may suspend or terminate a Tour Operator’s access to the Platform for failure to comply with KYC requirements. Conduct: All Users are expected to interact respectfully with others and refrain from engaging in any conduct that is unlawful, harassing, abusive, discriminatory, or otherwise disruptive. Moto Reveries reserves the right to suspend or terminate accounts of Users found to be in violation of this provision. Property: Users are solely responsible for any damage caused to physical property, such as motorcycles, equipment, accommodations, or facilities, during the course of a tour or training session. Liability for such damage shall be determined in accordance with the applicable Tour Operator’s terms and local laws. On-Platform Communication: All communications between Riders and Tour Operators, including but not limited to booking inquiries, modifications, cancellations, and disputes, must be conducted exclusively through the Platform’s messaging system. Off-platform communication is strictly prohibited and may result in account suspension or termination. Identity Verification: Moto Reveries may conduct identity verification checks on Users at any time, including through third-party services. Fraudulent or misrepresented identities may result in immediate account suspension or legal action.

INDEMNITY

Indemnity by Users: Users agree to indemnify, defend, and hold harmless Moto Reveries, its affiliates, officers, directors, employees, agents, and associated Tour Operators from and against any and all claims, liabilities, damages, losses, demands, expenses, and costs (including reasonable legal fees) arising out of or in connection with: (a) Any misuse or unauthorized use of the Platform or Services; (b) Any breach of these Terms or the applicable terms and conditions of a Tour Operator; (c) Any infringement or alleged infringement of intellectual property or other rights of a third party through User-Generated Content; (d) Any injuries, losses, damages, or incidents sustained during participation in any tour, trip, or training session booked through the Platform, to the extent not caused by the gross negligence or willful misconduct of Moto Reveries. Indemnity by Tour Operators: Tour Operators agree to indemnify, defend, and hold harmless Moto Reveries, its affiliates, officers, directors, employees, agents, and Riders against any and all claims, liabilities, damages, losses, demands, expenses, and costs (including reasonable legal fees) arising from or in connection with: (a) The provision, management, or delivery of their tours, training sessions, or related services; (b) Any breach of their own terms and conditions or applicable laws, regulations, permits, or licensing requirements; (c) Any act, omission, negligence, or misconduct by the Tour Operator or their employees, subcontractors, or agents; (d) Any injuries, losses, or damages sustained by Riders or third parties during tours or training sessions, to the extent not caused by the gross negligence or willful misconduct of Moto Reveries. Indemnity by Moto Reveries: Moto Reveries agrees to indemnify and hold harmless Users from and against any direct claims, damages, or losses arising solely from: (a) A material breach by Moto Reveries of these Terms; or (b) Gross negligence or willful misconduct by Moto Reveries in the provision of the Services. The indemnity obligations set forth in this Section shall survive the termination or expiration of a User’s access to the Platform and remain in effect for a period of two (2) years following the termination of Services.

CONFIDENTIALITY

For the purposes of this Agreement, “Confidential Information” shall mean all non-public, proprietary, or sensitive information, whether oral, written, electronic, or in any other form, disclosed by either Party (“Disclosing Party”) to the other Party (“Receiving Party”) in connection with the Services. This includes, but is not limited to: User or customer data; Business operations, strategies, or methods; Technical and financial information, pricing, and commercial terms; Trade secrets, intellectual property, and product/service-related data; Any other information identified as confidential at the time of disclosure or that reasonably should be understood to be confidential given the nature of the information. Confidential Information shall not include information that:(a) is or becomes publicly available through no fault of the Receiving Party; (b) was lawfully known to the Receiving Party prior to disclosure by the Disclosing Party; (c) is lawfully disclosed to the Receiving Party by a third party without restriction; or (d) is independently developed by the Receiving Party without reference to the Disclosing Party’s Confidential Information. The Receiving Party agrees to: (a) use the Confidential Information solely for the purpose of performing its obligations under this Agreement; (b) restrict disclosure of the Confidential Information to its employees, agents, or contractors who have a need to know and are bound by confidentiality obligations at least as restrictive as those set forth herein; and (c) implement reasonable safeguards to protect the confidentiality of such information. Upon termination or expiration of this Agreement, or upon the written request of the Disclosing Party, the Receiving Party shall promptly return or destroy all Confidential Information in its possession, except as required to be retained by applicable law or regulatory obligation. The Parties acknowledge that any breach of this clause may cause irreparable harm to the Disclosing Party for which monetary damages may be inadequate. Accordingly, the Disclosing Party shall be entitled to seek injunctive or equitable relief, in addition to any other legal or equitable remedies available at law or in equity.

INTELLECTUAL PROPERTY RIGHTS For the purposes of this Agreement, “Intellectual Property” refers to all forms of legally protectable rights and interests arising from intellectual and creative activity, including but not limited to: Copyrights (including rights in software, code, text, images, audio, video, and audiovisual content); Trademarks, service marks, trade names, trade dress, logos, and domain names; Patents, patentable inventions, and utility models; Design rights, whether registered or unregistered; Trade secrets, know-how, and proprietary business information; Moral rights and all other similar rights recognized under applicable laws. All Platform Content, including but not limited to the website design, interface, software, source code, databases, text, photographs, illustrations, videos, audio clips, graphics, and trademarks (collectively, “Platform Content”), is the exclusive Intellectual Property of Moto Reveries or its third-party licensors. Such content is protected by applicable intellectual property laws and international conventions. Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for personal, non-commercial purposes, strictly in accordance with these Terms. No rights are granted to copy, reproduce, modify, adapt, create derivative works, distribute, perform, or display any Platform Content without the express prior written consent of Moto Reveries. By uploading, posting, or otherwise submitting any content to the Platform, including but not limited to photographs, videos, text, comments, feedback, or other materials (“User-Generated Content”), the User retains ownership of such content but grants Moto Reveries a perpetual, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, reproduce, adapt, publish, display, perform, distribute, and otherwise exploit such content for the operation, improvement, and promotion of the Platform, including in marketing and advertising, across all media formats and distribution methods now known or later developed. Moto Reveries also reserves the right to review, moderate, or remove User-Generated Content that violates these Terms, is unlawful, offensive, or otherwise inappropriate, at our sole discretion. Users may opt out of having their User-Generated Content used for promotional or marketing purposes by submitting a written request to admin@motoreveries.com, clearly identifying the content to be excluded. Moto Reveries will make reasonable efforts to comply within thirty (30) days of receiving the request, subject to any pre-existing promotional commitments. Any unauthorized use of the Platform Content, trademarks, or any other Intellectual Property owned or licensed by Moto Reveries constitutes a material breach of these Terms and may result in immediate account suspension or termination, and/or legal action including injunctive relief and claims for damages.

DATA PROTECTION

Moto Reveries is committed to protecting your personal data and complies with the General Data Protection Regulation (GDPR) and all other applicable data protection and privacy laws relevant to its operations. We collect and process personal data strictly for the purpose of providing our Services. This may include, but is not limited to: Full name and contact details; Payment and billing information; Government-issued identification and documentation for Know Your Customer (KYC) verification; Booking history and user preferences. Personal data may be shared with: Tour Operators, solely to the extent necessary to fulfill your Booking or enable service delivery; Law enforcement, regulatory bodies, or government authorities if required under applicable law, legal obligation, or court order. In accordance with applicable data protection laws, Users have the right to: Request access to the personal data we hold about them; Request correction of inaccurate or incomplete personal data; Request erasure of personal data, subject to legal and regulatory limitations. All data-related requests must be submitted in writing to admin@motoreveries.com. Moto Reveries retains personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by law. Unless legally obligated to retain data for a longer period, all personal data will be permanently deleted within thirty (30) days following the termination or closure of a User’s account. Upon account deletion, Moto Reveries will cease using User-Generated Content for promotional purposes within thirty (30) days, unless the content has been anonymized or is part of pre-existing marketing materials that cannot be reasonably altered. Moto Reveries implements appropriate technical and organizational security measures to protect personal data against unauthorized access, disclosure, alteration, or destruction. Moto Reveries may collect and analyze usage data and interactions across the Platform to improve service quality, ensure safety, and personalize content, in accordance with its Privacy Policy.

PRIVACY POLICY

Our Privacy Policy, available on the Platform, details how we collect, process, and protect personal data. By using our Services, you consent to these practices.

TRAVEL INSURANCE

Recommendation: Riders are strongly advised to obtain comprehensive travel insurance prior to commencing any tour or training session. Coverage should include, but is not limited to: Trip cancellations or interruptions; Emergency medical expenses and evacuation; Personal liability coverage; Loss, theft, or damage to motorcycles, riding gear, or other equipment. Claims Responsibility: Riders are solely responsible for filing and pursuing insurance claims directly with their chosen insurance provider. Moto Reveries shall not be responsible for the outcome of any such claims.

LIMITATION OF LIABILITY

Disclaimer of Liability: To the fullest extent permitted by applicable law, Moto Reveries, its affiliates, directors, employees, agents, and representatives shall not be held liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage, arising out of or in connection with: the use of or inability to use the Platform or Services; any act, omission, misconduct, breach of duty, or negligence by a Tour Operator, their employees, subcontractors, or agents; any incident, injury, accident, loss, delay, or damage sustained by a Rider during a tour, training session, or related activity, regardless of the cause. Voluntary Assumption of Risk: Riders expressly acknowledge and accept that participation in motorcycle tours, training sessions, and related activities involves inherent and foreseeable risks, including but not limited to bodily injury, illness, property damage, mechanical failure, road and weather conditions, and the actions or omissions of third parties. By engaging in any such activity, Riders voluntarily assume all such risks and agree to release, waive, and hold harmless Moto Reveries from any and all liability, claims, or demands arising therefrom. Motorcycle tours and training sessions involve significant risks, including bodily injury, property damage, or death. By booking, you acknowledge and assume these risks.

FORCE MAJEURE

Moto Reveries shall not be liable for any delay, disruption, or failure to perform obligations under these Terms due to circumstances beyond its reasonable control (“Force Majeure”), including but not limited to: natural disasters, pandemics, war, terrorism, governmental restrictions, civil unrest, or infrastructure failure. In the event of a Force Majeure, Moto Reveries will notify affected Users within seven (7) days of becoming aware of the event and will take reasonable steps to mitigate its impact. Any additional costs or losses incurred by Users as a result of a Force Majeure event, including but not limited to rescheduling, accommodations, or transportation, shall be the sole responsibility of the User.

TERMINATION

Termination by Moto Reveries: Moto Reveries reserves the right, at its sole discretion, to suspend or terminate a User’s access to the Platform or Services, with or without prior notice, under any of the following circumstances: Violation or breach of these Terms and Conditions; Non-payment or failure to make timely payments for any Booking or Service; Engagement in unlawful, fraudulent, abusive, or disruptive behavior that may harm the Platform, other Users, or any third parties. Termination by User: Users may terminate their account or cancel their Bookings at any time. However, such cancellation shall be subject to the applicable Tour Operator’s cancellation and refund policy as outlined in Section 7 of these Terms. No Refund upon User Breach: In the event of termination by Moto Reveries due to a User’s breach of these Terms, the User shall not be entitled to any refund or credit for unused Services, regardless of prior payments made.

GOVERNING LAW AND JURSIDICTION

These Terms and any dispute arising out of or in connection with them, including their existence, validity, or termination, shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to any principles of conflicts of law.

DISPUTE RESOLUTION

Negotiation: In the event of any dispute, controversy, or claim arising out of or in connection with the use of the Platform or Services, the parties shall first attempt to resolve the dispute amicably through good-faith negotiations within thirty (30) days from the date of written notice of the dispute. Arbitration: If the dispute remains unresolved after the thirty (30) day negotiation period, the dispute shall be referred to and finally resolved by binding arbitration administered by the London Court of International Arbitration (LCIA) in accordance with the LCIA Arbitration Rules, which are deemed to be incorporated by reference into this clause. The seat and venue of arbitration shall be London, United Kingdom. The arbitration shall be conducted by a sole arbitrator appointed in accordance with the LCIA Rules. The language of the arbitration shall be English. The arbitral award shall be final, binding, and enforceable in any court of competent jurisdiction. Small Claims: Notwithstanding Section 20.2, disputes involving claims not exceeding £10,000 may be resolved in a small claims court in England and Wales, at the discretion of the claimant. Stripe Payment Disputes: Any dispute specifically relating to payment transactions processed via Stripe shall be governed by and subject to Stripe’s dispute resolution procedures, as may be amended from time to time. Survival of Dispute Resolution Clause: This Dispute Resolution Clause shall survive the termination, expiration, or suspension of a User’s account or cessation of Services on the Platform.

DISCLAIMER

The Platform and all Services are provided on an “as-is” and “as-available” basis, without warranties of any kind, express or implied, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement. Moto Reveries does not guarantee the safety, quality, or delivery of services provided by Tour Operators, nor does it endorse or warrant any third-party service. We do not warrant that the Platform will operate uninterrupted, error-free, or free from viruses or other harmful components.

MISCELLANEOUS

Entire Agreement: These Terms, together with our Privacy Policy and any additional agreements or policies expressly incorporated herein, constitute the entire agreement between you and Moto Reveries regarding the use of the Platform and Services. They supersede all prior or contemporaneous communications, representations, understandings, or agreements, whether oral or written. Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed, and the remainder of the Terms shall remain in full force and effect. No Waiver: No failure or delay by Moto Reveries in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof. Any waiver must be expressly stated in writing to be valid. Assignment: You may not assign, delegate, or transfer your rights or obligations under these Terms without the prior written consent of Moto Reveries. Moto Reveries may assign or transfer its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. Such notices shall be deemed received upon actual receipt or three (3) business days after dispatch by certified mail, return receipt requested, whichever is earlier. Electronic Acceptance: By accessing or using the Platform, or by clicking “I Agree” or similar terms, you agree to be bound by these Terms electronically, which shall be binding and enforceable as an original signature. Survival: Any provisions which by their nature should survive termination shall survive, including but not limited to provisions relating to intellectual property, indemnification, limitation of liability, dispute resolution, and confidentiality. Modifications to Terms: Moto Reveries reserves the right to modify or update these Terms at any time, in its sole discretion. The most current version will be posted on the Platform, and such updates shall take effect immediately upon posting. Your continued use of the Platform following any such changes constitutes your acceptance of the revised Terms. We encourage Users to periodically review the Terms for updates. Discontinuation of Services: Moto Reveries reserves the right to discontinue or suspend the Platform or any of its Services, including subscription-based features, for operational, legal, or business reasons. In such an event, Moto Reveries will provide Users with at least thirty (30) days’ advance notice via email or through the Platform. Where applicable, Users with prepaid subscriptions will be eligible for a pro-rata refund for the unused portion of their subscription, unless otherwise required or restricted by law.

By accessing or using the Moto Reveries Platform or any of its related Services, you acknowledge and confirm that: You have read, understood, and agreed to be legally bound by these Terms and Conditions; You are of legal age and have the capacity to enter into binding agreements under applicable law; You have reviewed and accepted the applicable Tour Operator’s terms, where relevant, prior to making any Booking; You understand the inherent risks associated with motorcycle-related activities and voluntarily assume all such risks; You have reviewed our Privacy Policy and Data Protection terms and consent to the collection, use, and processing of your personal data as described therein. If you do not agree to any part of these Terms, you must refrain from using the Platform or any of its Services.
